Council Members Cole, Kamen, Lambke; present. Council Members *Ferris, *Gale, Rogers; absent. Chris Cherches, City Manager; Gary Rebenstorf, Director of Law; Pat Burnett, City Clerk; present. The invocation was given by Maher Elassi, Islamic. The pledge of allegiance to the flag was participated in by the Council Members, staff, and guests. Minutes -- The minutes of the regular meeting of April 7, 1998, were -- approved approved 4 to 0. (Ferris, Gale, Rogers; absent) AWARDS AND PRESENTATIONS PROCLAMATIONS Mayor Knight presented the Proclamations that were previously approved. *Council Member Gale present. PUBLIC AGENDA COMMENTS BY DAN BORST. Dan Borst Dan Borst spoke regarding the WTA bus service and suggested that instead of the bus stopping in front of a homeowner's yard at Douglas and Meridian, a booth or pick- up station be installed on the west side of Meridian at the school yard. Council Member Kamen Council Member Kamen suggested Mr. Borst talk to the WTA Board regarding requests for specific stops or routes. *Council Member Ferris present. COMMENTS BY JOHN R. ANDERSON. Mr. Anderson was not present. UNFINISHED BUSINESS YOUTH COUNCIL PRESENTATION BY YOUTH COUNCIL. Members of Wichita's Promise Youth Council gave the following report: The Mission is to act as a positive voice for youth; to advise and take action on issues facing the community and give representation in order to bring about positive changes in Sedgwick County through youth involvement. The goals and objectives are: 1) To identify issues and take action when appropriate. The Council will meet once a month and invite the input of youth of all diversities through media promotion and other means of communication. 2) To form a partnership with community leaders and promote an environment of mutual respect by meeting with the City Council and Mayor every two months, and making the Youth Council available as an advisory council to other members of the community. 3) Further the mission of the founding members by maintaining consistent membership by providing one member for every 500 students from each Wichita or surrounding area high school (with at least two students from each school regardless of enrollment). The Youth Council will try to have involvement of the youth in the City and will write articles for the newspaper, develop a Web site, have a float in the River Festival parade, and do PSAs regarding the Youth Council. Mayor Knight Mayor Knight suggested the City Manager and Director of Law draft and ordinance to address having the Youth Council as an advisory council; and that the Ordinance be returned to the City Council for a public hearing. Chris Cherches City Manager said Keith Lawing, an intern in the City Manager's Office would be the liaison with the Youth Council. The Youth Council should consider whether to remain as a youth council or whether they would prefer to have youth representation on the various existing Boards and Commissions. There was no further action taken on this Item. OFF AGENDA ITEM HOUSING FOR PAROLEES. (Rogers absent) Mayor Knight Mayor Knight said he had received a FAX from Chuck Simmons, Secretary of Corrections, with information regarding parolee numbers and a message that there had been no intentional placing of unfair numbers of parolees in Wichita. Motion -- Knight moved that the City Manager and Police Chief be directed to meet right away to assess the numbers and that an assessment and recommendations with regard to whether or not the system is fair to the City of Wichita be brought back at -- carried the earliest possible time. Motion carried 6 to 0. (Rogers absent) NEW BUSINESS PETITIONS PETITION TO PAVE EDWARDS FROM ELM TO NINTH STREET. (District VI) Mike Lindebak City Engineer reviewed the Item. Agenda Report No. 98-293. The signatures on the Petition represent one of eleven ownerships that own 57% of the improvement district area. CPO Council 6 considered the Petition on March 11, 1998. The Council voted 6-2 to recommend approval. Edwards, north of Elm, is a sand street with single family homes along the west side and an expansion of the Riverside Health Center on the east side. The estimated project cost is $232,000. The method of assessment is the front foot basis. The estimated rate of assessment is $66.19 per front foot. The signatures on the Petition represent one of eight ownerships that own 60% of the improvement district area. CPO Council 6 considered the Petition on March 11, 1998. The Council voted 7-1 to recommend approval. The project will serve a group of single family homes along the west side of Edwards Street and an expansion of the Riverside Health Center. The estimated project cost is $85,000. The method of assessment is the front foot basis. The estimated rate of assessment is $26.44 per front foot. PETITION FOR A WATER DISTRIBUTION SYSTEM SOUTH OF 53RD STREET NORTH TO NORTH OF 55TH STREET NORTH EAST OF SENECA. (District VI) Mike Lindebak City Engineer reviewed the Item. Agenda Report No. 98-295. The signatures on the Petition represent 71 of 121 owners that own 59% of the improvement district area. CPO Council 6 considered the Petition on March 11, 1998. The Council voted 8-0 to recommend approval. A Supplement Agreement with Municipal Engineers for the preparation of construction plans has been prepared. The firm is currently designing an adjoining water system. The improvement district is primarily comprised of single family homes that are served by private water wells. An area of contaminated groundwater is located nearby. The estimated project cost is $257,000, with the total assessed to the improvement district. The proposed method of assessment is the fractional basis. The estimated assessment to individual properties is $2,400 for lots of 22,000 or less square feet of area and $3,600 for lots over 22,000 square feet of area. Mike Lindebak City Engineer explained that after looking at the improvement district, the square foot basis was a more typical assessment. Shirley Pulma Shirley Pulma said their water is bad and they have purchased bottled water for years. Motion -- Cole moved that the Petition be approved and the Resolution be adopted; and the Supplemental Agreement be approved and the Mayor be authorized to execute. -- carried Motion carried 6 to 0. R-98-118 Resolution of findings of advisability and Resolution authorizing construction of Water Distribution System Number 448-89255 (east of Arkansas Avenue, north of 37th Street North) in the City of Wichita, Kansas, pursuant to findings of advisability made by the Governing Body of the City of Wichita, Kansas, presented. Cole moved that the Resolution be adopted. Motion carried 7 to 0. Yeas: Cole, Ferris, Gale, Kamen, Lambke, Rogers, Knight. PROPOSED ASSESSMENTS PUBLIC HEARING ON PROPOSED ASSESSMENTS FOR WATER AND SEWER PROJECTS. Agenda Report No. 98-297. The Council was notified on March 17, 1998, that the proposed assessment rolls were on file for public inspection in the Special Assessments Section of the City Clerk's office. Notice of hearing was published March 27, 1998, ten days prior to the date of hearing, and affected property owners have been notified in writing. City personnel held an informal hearing April 2, 1998,, for the 39 sewer projects. Statements of Special Assessment will be mailed April 24, 1998. The property owners have 30 days from date of statement to pay their assessment and avoid paying interest. The assessments not paid during this period will be in the July Bond Sale and put on the 1998 tax roll over a 15-year spread at the interest rate for which the bonds sell. These projects were initiated pursuant to provisions of K.S.A. 12-6a01 et seq. Ray Trail Director of Finance reviewed the Item. The proposed 1998-2007 Capital Improvement Program exceeds $897 million over the ten-year period. The capital program is diverse in meeting capital needs for new and reconstructed roadways, parks, public facilities, infrastructure for new residential development, downtown development, public transit, and City enterprises (water, sewer, storm water, airport, and golf). The property tax (10 mills) provides 25 percent of the financial resources supporting the capital program. Another significant revenue source is federal/state grants at 14 percent of the total. New residential development capital costs are paid from special assessments at 15 percent. The City's enterprise activities fund capital projects through fees constituting 43 percent of total CIP financial resources. Local Sales Tax is funding only 3 percent of the proposed CIP at this time, and is based on freeway segments approved by the City Council to date. Additional Local Sales Tax resources are available to finance new freeway construction at such time as a determination is made on future freeway construction priorities in 1998 if federal or state highway funds become available. Capital projects are financed in a variety of ways: general obligation bonds/notes, revenue bonds, grants, and cash. The most significant is general obligation (GO) bonds based on the full faith and credit of the City. GO bonds provide debt financing not for property tax funded projects, capital projects with debt paid by enterprises, and special revenues such as the Guest Tax. Debt service payments for GO debt are spread either to the Debt Service Fund or the various enterprise and internal service funds, as appropriate. David Warren Director of Water and Sewer said there has been significant expense with the development of future water supply for the City. Council Member Lambke Council Member Lambke spoke regarding Fire Station Number 6 and questioned the rationale of it being set back in the CIP. Larry Garcia Fire Chief explained that there had been no provision made previously for purchase of a site. The site purchase is now scheduled for 1999 with construction scheduled for 2001. There is a need for the fire station. OSHA has now mandated that there be no entry into a structure with fire without a back-up team on site. This means the previous practice of entering a burning building immediately upon arrival, knowing a back-up team is on the way, is no longer possible. The southeast fire station is important as the response time is already at the maximum. A Fire station is also needed for the far northwest. Because of increased annexation, the Fire Department cannot continue to provide response the City is used to - even with the first responder program if resources are not provided. Council Member Lambke Council Member Lambke said there is an increase in manufactured homes in the southeast and that he would like to ask that Fire Station No. 6 land acquisition be set up for 1998 with design build in late 1999. Mayor Knight Mayor Knight asked that the City Manager and Staff return with an analysis on moving the project up for construction in 1999; and that the Director of Finance and City Manager meet with the Fire Chief regarding the implications and the possibilities with existing stations. Council Member Ferris Council Member Ferris said he would like the Fire Chief and Staff to analyze the entire Fire Department and needs and return the analysis to the City Council. Council Member Ferris said he is not willing to compromise fire safety of the community for parking lots and bridges. Mayor Knight Mayor Knight inquired if anyone wished to be heard. Stan Wilson Stan Wilson, Joyland Amusement Park owner, said the Gypsum Flood Control is unfunded and a major flood would cost his business a lot of money. Any excess water floods the parking lot and the rest of park has 4 to 10 inches of water. Mr. Wilson stated that he has been working with Mr. Mitchell to find a workable plan for presentation. Steve Lackey Director of Public Works said the previous project to improve the section was a concrete lined channel which the review agencies objected to as being not environmentally friendly. The design needs to try to maintain the basic alignment and vegetation. Permits were received to build the revised design but Mr. Nelson felt the revised design was not sufficient to address the flow needs in the area. Mr. Mitchell has been trying to get the review agencies to change their opinions so the original design can be used but no response has been received to-date. The project, if built as designed the second time, would cost $2 million. If the debate is to continue with the review agencies, the City is in a holding pattern until an answer is received. Jay Swanson Jay Swanson, Wichita Crime Commission and Co-Chairman of the Leadership Committee of the Long Range Planning Task Force, spoke in support of an advisory referendum of Sedgwick County voters as an appropriate way to test public support for the merger of the two governments. Mr. Swanson urged the City Council to place such an advisory referendum on the ballot for City voters and said he would recommend that the Sedgwick County Commission do the same for county voters outside the City of Wichita. On November 6, 1997, the City Council approved a new governance structure for the Wichita Art Museum. Effective January 1, 1998, the City of Wichita succeeded the Wichita Art Museum Board to the rights, obligations, and control over the Wichita Art Museum. The former Board held several trusts in its name, primarily the Burneta Adair Endowment Trust and the Wichita Art Museum Board Trust (consisting of a number of individual trusts), invested at several local banks. A number of these trusts have restrictions on the use of the principal or income placed by their grantors. The City of Wichita succeeded to the fiduciary responsibility for the investment, management, and proper use of these trusts. All decisions relating to the trusts now rests with the City Council, and affirmative direction through Council action is necessary for any decisions on use of the trust funds or changes in investment and management. The Council may make the decision, however, to delegate any or all of these decisions to the new board (the Wichita Art Museum, Inc.). On January 6, 1998, the City Council approved an agreement with the Wichita Art Museum, Inc. (a _501(c)(3) tax exempt corporation) to take over the operation and management of the Art Museum. The ordinance and agreement delegated management control over the works of art to the new Board (decisions on disposition or transfer of title of art works must still be approved by Council). The new board has now also asked to have direct responsibility for the management and use of the trust funds for the continued operation of the Museum. The Supplement Agreement delegates the Wichita Art Museum, Inc., to act on behalf of the City and have general supervision and management of all the existing and future Art Museum trust funds. This board is required to invest and use the funds in accordance with any restrictions and conditions placed by the grantors and in compliance with statutory fiduciary responsibilities. It may amend restrictions placed by only the old WAM Board, however. The new board will report on the investment and use of the trust funds in its periodic reports to the City Council and through Council review of the Art Museum budget. The Kansas Department of Transportation (KDOT) has available a street resurfacing (KLINK) program for cities which have highway connecting links within their city limits. The KLINK program is intended for resurfacing improvements on the connecting links which are maintained by the cities. KDOT has advised the City of Wichita that KLINK Fiscal year 1999 funds in the amount of $150,000 have been allocated for a resurfacing project on Kellogg from the Kansas Turnpike east to Greenwich Road. The Agreement provides that KDOT will reimburse the City in the amount of 50 percent of the approved construction cost including construction engineering and contingencies, but not to exceed a maximum of $150,000. The City plans to take construction bids for the project in mid-July. $300,000 is available in the Street Maintenance budget. On November 4, 1997, the City Council approved a Petition for a water distribution system to serve an area north of 46th Street North and east of the Little Arkansas River. On January 6, 1998, the City Council entered into an Agreement with Municipal Engineers, P.A. to design the improvements. The fee was $53,550. The Design Agreement with Municipal Engineers requires Municipal Engineers to provide additional engineering services if requested by the City. On March 17, 1998, the City Council approved a Resolution for a water distribution system to serve an area west of Arkansas Avenue and south of 53rd Street North. Both improvement districts have recently been annexed into the City and are developed primarily with modest single-family homes. Since this is Construction and Survey's peak workload period and due to the distance of the projects, City staff recommends contracting with Municipal Engineers for the staking. Payment to Municipal Engineers for Supplemental Agreement No. 1 will be made on a lump sum basis of $26,450. On June 12, 1990, the City Council entered into an Agreement with Baughman Company, P.A. for the design of paving improvements for Murdock from Waco to Wabash, and an 8" water line in Murdock from Broadway to Wabash. Payment to Baughman Company totaled $111,100; $96,700 for the paving improvements and $14,400 for the water line design. On February 4, 1997, the City Council approved construction of the project. Final plan revisions were required for pavement width changes including revisions to the storm sewers, railroad crossings, sidewalks, resurveying for new construction (initial plans completed), and generally updating the plans to current status with new bid quantities. On June 3, 1997, the City Council entered into a second agreement with Baughman Company for the plans revisions. The fee was $67,400. Since the second set of plans have been completed, Water Department staff identified water lines that are in conflict with the revised set of plans. Baughman Company has been asked to redesign the affected plans. Payment to Baughman Company for this Supplemental Agreement will be made on a lump sum basis of $5,900 from funds available in the project budget. The funding source is Water Utility. (Rogers absent) INTERVENTION GUARD CONTRACT AMENDMENT FOR GUARD AND PATROL SERVICES FOR WICHITA INTERVENTION PROGRAM. Agenda Report No. 98-307. Security guards, working under the direction of an instructor hired by Municipal Court, provide supervision (on a continuous basis) of Wichita Intervention Program drunk drivers attending the program while confined at a motel. The City Council approved the contract to Wells Fargo Guard Services on February 25, 1997, and the contract expired March 31, 1998, with an option to renew under the same terms and conditions for one year or two successive one-year periods by mutual agreement of the parties. The contract amendment is required to include a 5 percent increase from $8.32 per hour to $8.74 per hour as submitted January 17, 1997, in the original proposal. (Rogers absent) EMERGENCY SEWER REPAIR EMERGENCY SEWER REPAIR - 15TH STREET AND VOLUTSIA. (District I) Agenda Report No. 98-308. On Friday, March 27, 1998, Sewer Maintenance attempted to clean the sanitary sewer line in the easement between Estelle and Volutsia from 15th Street North to 16th Street North. During the cleaning process, the cleaning equipment became lodged in the sanitary sewer pipe. Subsequently, Sewer Maintenance excavated at the point where the equipment was stuck in the line and removed the cleaner nozzle and hose. In repairing the area where the cleaning equipment became embedded, Sewer Maintenance discovered existing clay sewer pipe in very poor condition. Approximately forty feet of trench was excavated exposing the clay pipe in an attempt to locate a good section of pipe to which a new PVC pipe could be tied. The conclusion was that the entire pipe from 15th Street to 16th Street should be reconstructed. Immediate action was necessary to maintain sanitary sewer service to our customers. In addition, an open trench and potential sanitary sewer overflow is a safety and health hazard. Due to the size and complexity of this reconstruction, Sewer Maintenance requested that a contractor be hired to replace the line. Informal bids were requested with two local contractors responding. W. B. Carter was selected and began the project on April 2, 1998. There were no other practical alternatives to correcting the emergency situation. Capital Improvement Program, Reconstruction of Sanitary Sewers, (CIP# S-4) has a budget of $2,800,000 for 1998. On August 4, 1987, the Wichita City Council approved the issuance of $4,000,000 in Industrial Revenue Bonds, Series VII, 1987, to finance the construction of a building addition to be leased to and operated by Koch Industries, Inc., located at 4111 East 37th Street North. Koch Industries, Inc. has submitted a request that the property under the bond issue be deeded to Koch Industries, Inc. The renovations completed in Expo Hall exceeded preliminary cost estimates. As a result, some of the work planned in Century II could not be completed because of the shortage of funds. Work remaining is estimated at $250,000. This includes additional signage, restroom and dressing room improvements, connecting lobby improvements, furnishings, and related work. Under the terms of the Hotel at Old Town (HOT) Development Agreement, the City will design and construct a parking facility on the City- owned surface parking lot, immediately adjacent to the north of the Hotel at Old Town (Keen Kutter Building), generally located at 215 North Mosley. The project will also include a turn-in lane on Mosley in front of the hotel entrance, and a signalized crosswalk on First Street. On March 17, 1998, the City Council approved the project in an amount not to exceed $2 million, approved a contract for architectural services with Law/Kingdon, Inc. for $90,000, and adopted the bonding Resolution. The original design concept for the parking facility was for a three (3) level structure with a capacity of 189 spaces. At least 80 spaces were to be for exclusive use by hotel guests during the evening and nighttime hours. To satisfy the HOT Developer Agreement, an additional 20 spaces would have to be provided on an adjacent surface lot. Staff in conjunction with Law/Kingdon, Inc. has determined the cost and efficiencies of a three (3) level parking structure will not maximize the Old Town parking needs. It is recommended a four (4) level structure with 246 spaces at a cost not to exceed $3.3 million be considered. The larger facility would provide a total of 100 spaces for exclusive use by hotel guests without the use of an adjacent surface lot. Architectural and engineering fees for the larger facility will be $128,000 including reimbursable expenses. The revised cost of the Hotel at Old Town Parking Facility and related improvements is $3.3 million including architectural and engineering fees. General Obligation Bond financing for the related public improvements will be included in the Capital Improvement Program (CIP) for 1998 funding. The work scheduled for years 2000 and 2001 consist primarily of replacement of the infield, field drainage and irrigation improvements. COMMUNITY ARTS CENTER CONSTRUCTION SERVICES FOR THE COMMUNITY ARTS CENTER - CHANGE ORDER. (Dist. VI) Agenda Report No. 98-314. On November 19, 1996, the City Council approved the creation of a Community Arts Center project, authorized the selection of a design consultant, and approved the use of a City-owned facility located at 225 West Lewis (southeast corner of Lewis and Water Streets) as the location for the Wichita Community Arts Center, later named CityArts. This project was approved as a private-public venture, with matching funds to be derived from the private sector. On May 13, 1997, the City Council approved the Design/Builder Part I Agreement with Gossen Livingston Associates for design services associated with this project. On July 15, 1997, the Council approved Part II of the Agreement for construction with Key Construction, Inc., as the prime contractor. On October 21, 1997, the City Council approved a change order and a budget transfer of $37,548 in private donations toward the completion of Phase I construction. Phase I of the project was constructed in October 1997. This initial phase of construction included repair and/or replacement of walls, roof sections, doors, installation of lights, heating and air conditioning, toilet facilities and other modifications to make the facility weather-tight and secure. The City's Cooperative Labor program played a vital role in this project and allowed much of the interior demolition work to be accomplished with significant savings. Since the completion of Phase I construction, this project has been delayed pending additional revenues. Several fund raising events have been held and private donations received. With the receipt of this additional private funding, Phase II of the project is ready to begin. With the completion of Phase II, occupancy of the facility can commence. It is anticipated that staff and some of the operations will move (from the Evergreen Arts/Crafts Center) in May and June. To initiate this final phase of work, the City Council is asked to authorize the expenditure of these private funds, as they are received, to complete the project. The City has on hand $56,683 from contributions and fund raising events. Additional funding in an approximate amount of $75,000 is anticipated to be available to complete the project, excluding some exterior improvements that can be scheduled at a later date. A budget transfer and change order are necessary to continue with Phase II construction. These and other donations have been deposited in a Public Art Trust Fund (No. 731) and available to be transferred to this project. Private contributions received to date total $178,089.03. Utilization of the Trust Fund moneys established for the specific use of this facility may be used for construction if approved by the City Council. Imaging technology has been available for some time and costs have been dropping to make the technology quite cost effective. The City has been reviewing the technology and has been preparing for its use for several years. A Wichita Innovation Team (WIT) was formed in March, 1994 to study the technology. The team first identified the customers as citizens, departments, City Council and the media. The Team then conducted a survey of the City's departmental records and identified the customer's needs as accurate and accessible information/ copies, ability to store all City records, elimination of duplicate information, reduction of storage costs, centralized information system and cost control. Among several of their recommendations, the WIT Team concluded the Police Department project should proceed as the City's first imaging project. In June, 1996, the City Council adopted the Management Information Systems Strategic Plan prepared by the Warner Group and city staff. In the area of imaging and records management, this plan calls for conducting detailed feasibility studies on imaging opportunities, and pursuing a single vendor approach. This plan lists some of the potential benefits of implementing a document imaging system as: _ Simultaneous access to a document image by multiple users. _ Improved accessibility of archived documents. _ Elimination of misfiling or misplacement of imaged documents. _ Greatly reduced physical storage space requirements. _ Reduced need for photocopying. _ Improved customer service from faster and more complete document searches. The Municipal Court Task Force, comprised of individuals with a knowledge of both the legal system and also of good business and operational practices, completed its report in August 1995. One of their recommendations in the area of improved records management and administrative procedures is to implement an optical imaging system for court records. These records would include all charge documents and court disposition records. Through a committee made up of representatives from the Police Department, Municipal Court, Law Department, Finance Department and Water and Sewer Utility, a request for proposal was developed and distributed. The responses were evaluated by this committee and demonstrations were completed by Compulink and Xerox. The committee is recommending Compulink for the system design and functional specification phase of the project. This process will determine the hardware and software requirements and define any software customizations that may be required. This company's proposal more directly addressed the city's requirements at a substantially lower cost. Although this company is much smaller than Xerox, they have extensive experience providing services, hardware and software to local governments for document imaging projects. The total cost of this contract is not to exceed $31,500 and expenses estimated at $7,000. Funding for this cost is available through the Local Law Enforcement Block Grant. Agenda Report No. 98-316. The City Council had previously approved IKON Office Solutions to provide Micrographic Services at the March 24, 1998 City Council meeting. Staff made a clerical error in a tabulation during the evaluation process. The award of micrographic services should be redirected to Microfilm Services with the corrected calculations. Two proposals were received in February 1998. The proposals were evaluated on the basis of pricing and ability to provide current levels of service while maintaining quality standards. Additional corrected calculations and research on both proposals were conducted, Microfilm Services submitted the lowest and best proposal. This vendor has provided the City of Wichita quality micrographic services for the last three years. City Departments will continue to budget for micrographic services in their respective budgets. (Rogers absent) PROPERTY ACQUISITIONS PROPERTY ACQUISITION OF A PORTION OF PROPERTY LOCATED AT 2826 WEST CENTRAL (TRACT #1) FOR THE CENTRAL AVENUE IMPROVEMENT PROJECT FROM WEST STREET TO MCLEAN. (District VI) Agenda Report No. 98-317. The Central Avenue Improvement Project from West Street to McLean Boulevard, approved by Council on September 17, 1996, requires the partial acquisition of three tracts along the north side of Central near St. Paul. Two of these tracts were acquired in 1997 with this being the final required acquisition. On June 3, 1997 the City Council approved the acquisition of Tract #2 which is owned by Keith Zody for $13,530. Prior to closing, it was learned that the tenant, QuikTrip, in accordance with their lease agreement, has the right to adjust monthly rental payments downward by 1% of any sales proceeds ($135.30 per month). When QuikTrip exercised this right, the owner declined to close as the purchase price had been predicated on the value of the site and did not foresee any reduction in rent. The total tract contains 40,560 square feet and is developed as a QuikTrip convenience store. The tract being acquired contains 2,080 square feet. The acquisition tract is landscaped and is the location of the facility's sign as well as three employee parking spaces. As mentioned, the owner has agreed to sell the property to the City of Wichita for $13,530 or $6.50 per square foot, which is consistent with the value of other similar properties. The City has worked with QuikTrip to remediate the damages to the site as much as possible including moving their sign, replacing landscaping, etc. but the site will lose three parking spaces. This loss of parking prompted QuikTrip to exercise the rent reduction clause in their lease. While the owner was willing to discuss additional compensation to offset the loss in income, any increase in the purchase price would increase the rent reduction per the lease agreement with QuikTrip. QuikTrip was contacted to see if they would be amenable to a cash payment to forego the rent reduction to the owner. QuikTrip offered to settle for $11,227. This is amount is based on the present value of the future cash flow stream over the remaining 173 months of the lease discounted at QuikTrip's rate of return on this lease, 11.8%. The 1996 Capital Improvement Program includes $50,000 to acquire the necessary right-of-way for the project along Central. The funding source is General Obligation Bonds. The prior approved budget was $13,730 and included $13,530 for the acquisition and $200 for closing costs, and title insurance. The settlement and associated closing costs are estimated to increase the total budget by $11,500 to $25,230. Budgeted costs, including this request, total $39,530 to date. The proposed acquisition of property is within the Third Street Drainage project which was approved by the City Council in 1993. This project involved the removal of Third Street (from Lorraine to the drainage canal under I-135). A landscaped drainage corridor is in the final completion stages construction. The design of the project required the full or partial acquisition of residential properties that were within the development corridor. Now that the project is nearing completion, one property (402 North Chautauqua) has been found to be adversely impacted with the restriction on access. It is proposed that this property be acquired and utilized for the proposed greenway park area included in the overall design of this project. This property is legally described as Lot 28 and Lot 30 except the East 51 feet in Maple Grove addition to Wichita. The property is improved single family residence which is currently a rental property. An appraisal was prepared which values the property at $25,000. This amount was presented to the owners and they accepted the offer. The funding source will be appropriated general fund reserves. The budget of $26,000 includes $25,000 for the acquisition and $1,000 for miscellaneous items associated with the acquisition such as appraisals, closing costs and title insurance. PARK CITY AGREEMENT ACQUISITION OF WATER LINE FROM PARK CITY. (District VI) Agenda Report No. 98-319. With the requested extension of water service to the Riverview area, an examination of the distribution system recognized the existence of a distribution main owned by the City of Park City. This main was connected to local wells in the vicinity which served a number of customers in the recently annexed Riverview area. The City of Wichita is in the process of bringing public water supply to the Riverview area. The time frame for this has been accelerated by the discovery of a plume of contamination adjacent to a superfund site. The main in question should become part of the City of Wichita's distribution system serving this area. A total of $17,000 would be paid to Sedgwick County to retire remaining outstanding debt for the original financing of the project. Customers currently hooked to this distribution main and/or those who have applied for and paid all applicable fees to the City of Park City at the time of the adoption of the proposed agreement will become City of Wichita water customers. Wichita would agree to pay for all disconnection costs to the City of Park City and grant a right to Park City to approve the disconnection point prior to the disconnect work being done. Wichita will also acquire all appurtenances to this water line including meters, service lines, valves, fire hydrants, etc. Wichita would release Park City from that portion of the existing wholesale water service agreement which would require Park City to annex certain properties currently being served by local wells if it becomes necessary to serve these properties from other sources. Park City would also be released by Sedgwick County from the requirement to pay surcharges to Sedgwick County which have been paid by customers connected to this line. The net cost of $17,000 would be funded through Capital Improvement Project, Unidentified Mains Replacement (CIP #W-65). (Rogers absent) PROPERTY ACQUISITION EASEMENT ACQUISITION - EQUUS BEDS GROUNDWATER RECHARGE DEMONSTRATION PROJECT - (SEDGWICK COUNTY) Agenda Report No. 98-320. In November, 1995 the City Council approved the Equus Beds Groundwater Recharge Demonstration Project. The demonstration project is a phased, small-scale, investigative $3.4 million trial project to test the feasibility of a full-scale $106 million groundwater recharge, storage and recovery project to obtain state approval. The groundwater recharge project includes the capture of above base flow water (water which is generated from rainfall runoff above the base river flow) in the Little Arkansas River, the transfer to and storage of captured water in the aquifer, and the recovery and use of this captured water to meet future demands for Wichita, Halstead, Newton, Hutchinson, McPherson, Valley Center and other communities. The Equus Beds Aquifer underlies portions of Sedgwick, Harvey, McPherson and Reno Counties and is located within the boundaries of Groundwater Management District No. 2. Since the 1950's water levels in the aquifer have dropped 20 to 40 feet and as a result of heavy utilization. The project includes a field testing program, with $1.9 million to construct a data collection network to monitor groundwater, surface water, and water quality and to test and demonstrate the feasibility of the groundwater recharge plan. Sites for the testing and easements accessing them were selected by the project consultants Burns & McDonnell. The proposed easement will be used for the installation of piezometers, devices to measure the underground water level, within the Sedgwick County project area. The piezometers will help define the water levels as water is injected in to the Equus Beds. The City has successfully negotiated the purchase of a temporary easement for the installation of a piezometers on the Ida Sylvania Lies Living Trust farm for $250.00 for a 20 ft. by approximately 160 ft. easement. The easement is located as close to the tree row to avoid damaging crops. Funds for the property are available through the Water Supply Plan (Phase I and II), Equus Beds Groundwater Recharge Demonstration Project, CIP Project #W-403, as approved by the Council in November of 1995. The temporary easement will cost $250.00 per the easement agreement. Citizens have petitioned asking that the City's parking ordinances be amended to permit parking on one side of certain alleys in the Old Town District. The Old Town District is defined by reference to the Old Town Overlay Zoning District and the alleys in which the parking would be permitted would be those designated from time to time by the traffic engineer. Because of the unique nature of the Old Town District and the shortage of parking, it would be desirable to permit parking on one side of certain alleys in the District where such parking would not interfere with the public use of the alleys. At present, parking in alleys throughout the City is prohibited except for truck loading. This amendment would require the traffic engineer to determine which alleys are appropriate for parking on one side and would require signage to indicate that parking is permitted. The applicant, Jay Russell of JJJ, LLC, is requesting the annexation of property generally located south of Maple and west of 151st Street West in order to comply with platting requirements set forth by the Metropolitan Area Planning Commission. This property is bordered on the east by the current City boundary. According to the water agreement provided by the applicant the proposed annexation area consists of approximately 63.25 acres and will be developed with 75 single family residential lots. A final plat for the Reece Farms Estates has been heard and approved by the MAPC on August 14, 1997, subject to conditions. The site is currently undeveloped, but planned development is for a single family subdivision. The current zoning is "SF-20" Single Family; upon annexation the zoning will convert to the City's "SF-6" Single Family Residential zoning category. County land to the north is zoned "SF-20" Single Family and is developed with large lot single family residences. County land to the south is zoned "SF-20" and is developed with large lot single family residences. County land to the west is zoned "SF-20" and is used primarily for agricultural purposes. City land to the east is zoned "SF-6" and is will be part of the Auburn Hills golf course and single family residential area. County land to the east is zoned "SF-20" and is undeveloped but used for agricultural purposes. The general character of the surrounding area is that of agricultural uses mixed with single family development. The City Engineer's office indicates that City water service is available to serve this site from an existing 24" line along 151st Street West. The applicant will be responsible for all costs involved in connecting to this existing water line. City sewer does not currently serve this area, however the applicant has submitted a petition for sewer service, which has been granted. The applicant will also be responsible for extending sewer to meet the needs of this development. The property will have access to 151st Street West. Currently 151st Street is a 2-lane unimproved section line road. The applicant has agreed to pave 151st Street from Kellogg north to the entrance of Reece Farms Estates. There are no current traffic counts for this section of road, however the 2020 Transportation Plan projects a traffic count of 1,520 average daily trips (based on the 2020 land use allocation prepared in 1990). The Wichita Fire Department, operating out of Station Number 17, located at 10651 West Maple, can serve this site with an approximate 5 minute response time. Upon annexation, police protection will be provided to the area by the Patrol West Bureau of the Wichita Police Department which is headquartered at 661 North Elder (Elder and West Central). This area is located approximately 2 miles from The Meadows Park, which is a 96.38 acre community park that is being developed and will be designated a wildlife area. Future plans include picnic facilities, playground areas and pedestrian path throughout the park. The proposed annexation site is within 1 mile of an area that has been designated as a potential future park site by the Park and Open Space Master Plan, and across 151st Street from the planned new Auburn Hills golf course. The property is located in Unified School District 265 (Goddard Public School District). Annexation will not change the school district. This property is located within the urban growth area of the City of Wichita as delineated by the Comprehensive Plan for the metropolitan area, and is also inside the Policy 32 urban service area. The development of this site will include approximately 75 single family units with a total appraised value of approximately $5,775,000 which would result in a yearly tax revenue of $20,286 for the City of Wichita. On the basis of the foregoing information, the annexation of this property does not appear to result in future extraordinary expenses to the City-at-large. The applicant and property owner, Rick Thompson, is requesting annexation of property generally located ¼ mile north of Pawnee on the east side of Maize Road in order to comply with the platting requirements set forth by the Metropolitan Area Planning Commission. This property is bordered on the north and east by the current City boundary. Pawnee Prairie park adjoins the east side of the proposed property. According to the information sheet submitted by the applicant, the proposed annexation site consists of approximately 35.8 acres and will be developed with 127 single family residential lots (Attachment No. 2). The site is currently zoned for single family development and there is no proposal for rezoning at this time. A county plat of subdivision was recorded by the Register of Deeds on March 13, 1998. The site is currently undeveloped but planned to be a single family subdivision. The site is zoned "SF-6" Single Family. The land to the north is in the City and is zoned "SF-6" Single Family, "TF-3" Two-Family, and "LC" Limited Commercial. Pawnee Prairie Park, on the east, is zoned "SF-6" Single Family. The land to the south is zoned "SF-6" Single Family, "TF-3" Two- Family, "LC" Limited Commercial, and "GC" General Commercial. The land to the west across Maize Road, "Lindsey's Orchard," is still unincorporated, undeveloped and zoned "SF-6" Single Family. According to information provided by the applicant, the anticipated single family residential development of this site will include approximately 127 homes @ $80,000 per dwelling on 127 lots valued @ $5,000 per lot, resulting in a total estimated value of $10,795,000. Based on current City tax rates, the total estimated value would result in $38,764 of annual tax revenue for the City of Wichita. It is estimated that the proposed development will require five (5) years for completion. In addition, the estimated cost of extending the existing 16" water main south along Maize Road is $66,000 ($50 x 1320 ft.). This is a second annexation request by Rick Thompson. This property lies west of his other annexation request (A98-11), and includes the remaining Maize Road ROW approximately ¼ mile north of Pawnee. The proposed annexation site is comprised of three parcels of land that are contiguous. The site is bordered on the north and west by the current City boundary.
